Under certain conditions, precautionary attachment, or conservatoir beslag, can preserve assets before a final decision on a claim. It is neither payment nor proof that the creditor has already won. A lawyer applies for judicial permission; a bailiff actually carries out the attachment. If your business is affected, promptly examine the documents, operational consequences and possible alternative security relevant to lifting it. This guide concerns Dutch business disputes. Do not use attachment as an automatic threat over every unpaid invoice.

1. Distinguish security from collection
Precautionary attachment may protect recovery while the dispute still requires assessment. It differs from enforcement based on an appropriate enforceable title. Do not expect a frozen amount to arrive immediately in your account. Ask your lawyer to explain the purpose of attachment and the main proceedings still needed to establish your entitlement.
This distinction also matters to the affected business. A bank freeze does not mean a court has definitively awarded the whole debt. The application and permission granted may serve a different purpose from a judgment on the merits. Collect the actual court documents rather than responding only to statements by a bank employee or the opposing party.
2. Support the claim and need honestly
Bring the agreement, delivery evidence, invoices and payment details. Identify the legal counterparty and basis of your claim. Disclose objections and counterclaims received too. In a rapid assessment, your lawyer needs a complete picture of the relevant facts; do not omit unfavourable correspondence because it complicates your account. A disputed order requires more than an outstanding balance alone.
Explain why security is considered necessary and what specific information supports that view. If there is no proof, a suspicion that the debtor will dispose of everything must remain identified as suspicion. Collect, for example, an announced sale or another verifiable event. The measure must fit your file and risk; general anger about non-payment is not independent advice to attach assets.
3. Choose assets and parties carefully
Ask which assets may legally be considered for attachment and who owns them. An operating company, holding company and director do not automatically share debts or assets. A company logo on a vehicle does not prove ownership by your contracting party. Have known information assessed by lawyer and bailiff before presenting a specific asset as an established attachment target.
Discuss the effects on the other business too. Freezing a bank account may disrupt payments; attachment of a particular item has different practical effects. Necessity, scope and risk belong in the choice. Ask about less intrusive security and what happens if other attachments or security rights already exist.
4. Understand permission and implementation
According to Rechtspraak, the lawyer submits an attachment petition identifying the assets and reasons. Decisions are often based on documents without a prior hearing, but there are exceptions in which the debtor is heard. Leave authorises the measure; implementation by a bailiff is the next step. The exact decision determines what may be done.
Ask how communications and implementation will be coordinated. Do not announce an attachment independently if this undermines the chosen strategy. Conversely, the desire for speed must not justify superficial checking of the facts. Agree availability, required documents and costs. A statement that urgent action is possible does not guarantee approval on the same day.
5. Monitor the main-proceedings deadline and costs risk
Rechtspraak states that the court sets a deadline for starting main proceedings. Have that actual deadline recorded and monitored immediately. A party wishing only to attach assets but unwilling to have its claim examined must discuss this before the application. Attachment and the substantive proceedings are different tasks with connected costs.
Discuss court fees, lawyer and bailiff separately, including the risk of ultimately losing. Official guidance explains that unjustified attachment may create liability for resulting damage. That risk does not disappear because permission was requested. Explicitly include the prospect of a counterclaim and possible business consequences in the decision.
6. Respond specifically if your business is affected
Collect the attachment documents, leave, alleged claim and any ongoing main case. Describe the actual effects on wages, rent, deliveries or a planned transaction. Ask whether discussions, replacement security or proceedings to lift the attachment are appropriate. Evidence merely saying that you dispute the debt may be insufficient; the lawyer must present grounds and interests together.
A lawyer is required to start proceedings to lift attachment before the interim-relief judge who granted leave. Unlike ordinary summary proceedings, Article 705 of the Wetboek van Burgerlijke Rechtsvordering (Rv) imposes no separate requirement of urgent interest. The Midden-Nederland District Court confirms this in ECLI:NL:RBMNE:2026:5590. You therefore do not first need to prove a separate ground of urgency to use this route. Actual consequences and interests still matter to assessment and scheduling; the absence of special urgency does not guarantee lifting either. Supply complete financial information and have any offer of replacement security carefully worded.
7. Fictional example: account frozen after a delivery dispute
Suppose a supplier invoices a machine while the customer alleges serious defects. The supplier fears that an announced sale of business assets will reduce recovery. Following attachment of the bank account, the customer cannot make the next payroll payment. Both parties have a specific interest, but delivery and defects have not yet been definitively assessed.
A useful file contains the contract, complaints, planned sale and banking consequences. Security and possible lifting can then be examined alongside the main claim. This fictional example has no winner and does not justify every freeze. It shows why both the substantive dispute and necessity of the measure need attention.
8. Checklist for your attachment lawyer
Immediately explain whether you seek security or need attachment lifted. Put a specific upcoming payment, transaction or deadline at the top. Request an initial assessment of the claim, necessity, costs and alternatives before giving a targeted instruction.
- Correct parties, contract and full substantiation of the claim.
- All objections, counterclaims and payment information received.
- Reliable information about the asset and its ownership.
- Leave, attachment documents and actual main-proceedings deadline, if present.
- Operational consequences and possibilities for replacement security.
Frequently asked questions
Does attachment mean I receive my money immediately?
No. Precautionary attachment may preserve recovery. The substantive claim and any later enforcement are separate steps.
Do I need a lawyer to apply for attachment?
Yes. Rechtspraak states that representation by a lawyer is compulsory when applying for permission for precautionary attachment.
Can attachment against me be lifted?
There are routes through discussion or suitable proceedings. Have grounds, actual consequences and possible security assessed promptly.
Does judicial permission remove all risk?
No. Unjustified attachment may create liability for damage. Have the defence and proportionality examined too.
