Are you personally pursued as a director? Check who brings the claim, for which company and period. A letter to your BV is not automatically a personal liability claim.

A BV generally bears its own debts, but personal liability is possible. Claims by the company, supplier, insolvency practitioner or tax authority have distinct grounds. Ask which conduct is alleged.

Collect forecasts, warnings, minutes and advice available when you decided. Make a timeline. Do not alter old minutes to suggest your later explanation already existed then.

A personal surety differs from liability for your management duties. Bring complete financing contracts, guarantees and terms. A signature page alone gives no complete picture.

For certain self-assessed taxes, inability to pay must be notified within two weeks after payment was due. Additional assessments have separate conditions. Check pension fund notification too; requesting deferral does not replace notification.

Send formal documents promptly to a business lawyer. Check how to notify your directors' liability insurer. Insurance notification does not replace your response to court documents.
